These terms and conditions ("Terms") are with reference to your
participation in the 'Streaks' Offering
("Offering"). The Offering is organized by Irelia Sports India
Private Limited ("ISIPL"), the owner and operator of the
Gujarat Titans professional twenty20 cricket team ("Gujarat
Titans" or "GT"). The Offering is offered by
ISIPL on GT's TitansFAM App (the "Platform").
For the purpose of these Terms, "you" and "your" shall mean any
individual who wishes to participate in the Offering. Joining the Offering in the manner
provided under Paragraph 2 hereinbelow or acceptance of a Reward (as defined below) in the
manner provided under Paragraph 4 hereinbelow, shall constitute unconditional and
unequivocal acceptance of these Terms.
Participation Guidelines
Any person above 13 years of age and residing in India may participate in the Offering on
their own behalf only.Where any person between the age of 13-18 years seeks to participate
in the Offering, such person shall require the consent of his/her parent/legal guardian and
upon such person participating in the Offering, such consent shall be deemed to have been
obtained by such person from his/her parent/legal guardian.
No participation by proxy will be allowed.
Onlyindividuals who have a 'User Account' on the Platform
("Account") shall be eligible to participate in the Offering
("Users").
Users may develop and maintain streaks on the Platform
("Streaks") for the duration of the Term, in respect of three
(3) categories: (i) watching videos on the Platform; (ii) playing the 'Hand
Cricket' offering on the Platform; and (iii) logging steps on the Platform (each a
"Category"). By participating in one or more Categories, on an
uninterrupted and daily basis, User may achieve five distinct milestones, specifically at
10 days, 20 days, 30 days, 50 days, and the duration of the Season (each a
"Milestone"). The requirements in respect of each Milestone to
maintain Streaks are set forth in Annexure 1 herein. Users may participate in any or
all of the Categories and earn Points (as defined herein) and Badges (as defined herein). It
is clarified that Badges awarded across the three categories shall be independent of one
another. Accordingly, a User may hold a maximum of three (3) Badges, with
no more than one (1) Badge per Categoryat any given time.
Users who initiate their Streak after 22ndMarch 2025 shall not be eligible to
participate in or receive any Milestone designated for Users who have maintained a
Streak for the duration of the Season. However, such Users shall be eligible to participate
in or receive any Milestone designated for Users who have maintained a Streak for 10 days,
20 days 30 days and 50 days, as stated above.
Opening and Closing Date
The Offering's opening time and closing time ("Term"):
Opening time: March 22, 2025 at 12:00 AM IST; and
Closing time: May 25, 2025 at 11:59 PM IST.
You will not be eligible to participate in the Offering once the Term of the Offering closes
as set out under Paragraph 3(a) above.
ISIPL shall not accept any responsibility whatsoever for any technical failure or
malfunction or any other issues which may result from your Account not being properly
registered on the Platform or deregistered for any reason whatsoever.
Reward
Users participating in the Offering may earn GT loyalty points
("Points") and a digital GT badge that will appear on the
User's profile section on the Platform (each a "Badge"
and together with the Points, "Reward(s)"). It is clarified
that the Points earned by a User shall be subject to the terms and conditions governing
Points ("Points Terms").
The manner in which the Points and Badges are determined shall not be open to challenge.
Thus, complaints, disputes, or objections regarding the awarding of Points and/or Badges or
any other aspect of the Offering will not be entertained.
Each User that earns a Reward will be required to complete such steps as reasonably required
by ISIPL to validate his/her victory and award the Reward, after which the Points shall be
credited to the User's 'GT Rewards' section of the Platform and/or the
Badge shall be showcased on the profile of the User, as applicable.
ISIPL reserves the right to substitute any Reward with another without providing any notice.
A User that earns Points and/or Badges may be required to submit a video testimonial
("Testimonial"), as requested by ISIPL, at no additional cost
or charge to ISIPL.
Legal
Intellectual Property/Third Party Rights: By submitting any content on the
Platform or otherwise to ISIPL, you agree to grant ISIPL a royalty-free, world-wide,
non-exclusive, perpetual, irrevocable and assignable right to use, copy, reproduce, modify,
adapt, edit, translate, create derivative works from, transmit, and share your content and
to otherwise use such content. Such content may include, without limitation, your name,
username, location, and the Testimonial. You further agree and acknowledge that ISIPL has
the right to use in any manner whatsoever, all communication or feedback provided by you.
Users may, at the request of ISIPL, participate in all promotional activity (such as
publicity and photography) surrounding the winning of the Reward, free of charge, and they
consent to ISIPL using their name, likeness and image in all promotional activities
undertaken by ISIPL.
Indemnification: You hereby agree to indemnify, defend and hold harmless
ISIPL from and against all liability and costs incurred in connection with any claims
arising out of or relatingto your participation in the Offering, including but not limited
to any breach of obligations, representations or warranties in these Terms, or any claim
arising out of any breach of a third party’s rights of any nature by you.
Waiver: Your participation in the Offering is at your own risk and strictly
in accordance with these Terms. ISIPL bears no responsibility for any loss or damage
incurred as a result of your participation in the Offering, and you waive any claims against
ISIPL in relation thereto.
Breach of Terms: Any breach of these Terms, Points Terms, and/or the
Platform Terms and Conditions located at https://www.gujarattitansipl.com/terms-and-conditions
("Platform
Terms") will automatically void your participation in the Offering.
If a breach of any of the Platform Terms, Points Terms, and/or these Terms set forth herein
is discovered after the award of the Reward, then ISIPL has the right cancel such Reward
awarded to you.
Disclaimer: You acknowledge and agree that:
ISIPL shall neither be liable nor responsible for any actions or inactions of any
third party and hereby expressly disclaims any and all responsibility and liability
in that regard.
ISIPL shall neither be liable nor responsible for any damage, loss, injury or
disappointment suffered by any Participant as a result of entering the Offering or
accepting the Reward or any injury or damage to the Participant's or any other
person's personal property including but not limited to a computer or mobile phone
relating to or resulting from participation in the Offering.
The Reward is personal to the Users and is not transferable and cannot be sold under
any circumstances.
No Reward will be awarded if the information furnished by the User at the time of
entering the Offering or at any subsequent stage is factually incorrect.
In the event a winning User does not acknowledge/accept/collect his/her Reward
within the timeline stated by ISIPL, such User shall forfeit the Reward being
awarded, and ISIPL shall have the right to award the same Reward(s) to other
User(s).
You are aware that participation in the Offering does not guarantee a Reward to you.
All collection, storage, use and disclosure of any personal information provided by
you to ISIPL will be in accordance with ISIPL’s privacy policy available at:
https://www.gujarattitansipl.com/privacy-policy.
Promotional Communication: You hereby agree to receive promotional and
marketing communication including but not limited to email communication/newsletters,
WhatsApp messages, mobile SMS, call etc. from ISIPL from time to time. You further expressly
waive Do Not Call (DNC)/ Do Not Disturb (DND) registrations on your phone/mobile numbers for
contacting you for such promotional/marketing purposes.
General
ISIPL reserves, at its discretion, the right to: (i) vary these Terms without notice, including but
not limited to the opening and closing times for joining; (ii) withdraw, vary or substitute the
Reward associated with the Offering; (iii) disqualify any entrant who breaches the Platform Terms,
Points Terms, and/or these Terms or has acted fraudulently; or (iv) cancel the Offering at any
stage.
Governing Law and Jurisdiction
The Offering shall be governed by and
construed in accordance with Indian laws. Any disputes arising out of or in connection with the
Offering and/or your participation in the Offering will be subject to the exclusive jurisdiction of
the courts of Ahmedabad, India.
